WAIVER, RELEASE OF LIABILITY
Before joining our trips, all riders must go through the registration process, read, and understand our Release of Liability, Waiver of Claims, Assumption of Risks, and Indemnity Agreement. This document must be signed digitally during the registration process and again in person (with a paper copy) when you arrive for the trip in the presence of a witness. Please note that this document cannot be modified before signing. By registering and signing our waiver, it will form part of the contract with Mountain Bike Colombia S.A.S. (MBC). You can access and print a copy of our waiver at any time.
BOOKING POLICIES - Payments, Deposits, and Cancellations
We aim to provide you with complete information regarding our adventure payment, deposit, and cancellation policies. Your deposit, which amounts to 25% of the trip cost, can be refunded in full if you cancel your adventure 90 days prior to the scheduled departure date. However, if you cancel within 89 days of the departure date, your deposit becomes non-refundable. Nonetheless, you can transfer it to another adventure if you schedule it within the same calendar year. Kindly note the following cancellation terms:
- Adventure deposits are fully refundable if cancellation is made 90 days before the scheduled tour date.
- Adventure deposits become non-refundable if cancellation is made within 89 days of the scheduled tour date. However, you can apply your deposit towards a future adventure scheduled within the same calendar year.
- We strongly advise the purchase of travel/cancellation insurance.
- Although we strive to adhere to the scheduled departure dates of our adventures, rare occurrences such as acts of God or other unforeseeable events beyond our control can impact part or all of an adventure causing us to alter part of an adventure or may even necessitate total cancellation of the trip. If we are forced to cancel the entire trip you will receive a full refund of your deposit, plus a $500 USD credit towards another MOUNTAIN BIKE COLOMBIA ADVENTURE.
- Your final payment is due upon arrival and check-in Colombia, prior to our adventure departure.
- We offer a 5% cash discount on the balance of the adventure to offset bank charges.
- Please be informed that all cancellations must be made via email to info@mountainbikecolombia.com no later than 60 days prior to the scheduled departure date.
TRAVEL AND MEDICAL INSURANCE
To join a Mountain Bike Colombia Adventure, it’s mandatory for all riders to have medical insurance. You should purchase insurance once you’ve made a deposit for your trip. Colombian adventure medical insurance can also be purchased here as well. The insurance must provide coverage for personal accident, death, emergency remote evacuation (including helicopter evacuation), medical expenses, and emergency repatriation.
We strongly suggest you confirm that your insurance covers trip cancellation, curtailment, personal liability, and loss of luggage and personal effects. Before your adventure, we’ll ask you to provide proof of insurance. Please note that you won’t be able to join the adventure without it.
If you choose to travel without adequate insurance cover, Mountain Bike Colombia won’t be responsible for any losses that would have otherwise been covered by insurance.
CANCELLATION BY MOUNTAIN BIKE COLOMBIA
We may need to cancel or change a trip for various reasons, including planning ahead and other factors. If that happens, we’ll refund any payments you’ve made to us. However, once we confirm a trip, we don’t usually cancel it. Please note that we cannot be responsible for any losses you may incur from non-refundable airline tickets. Therefore, please contact us before booking your flights to make sure that the trip is confirmed and has enough participants registered.
PRE-TRIP INFORMATION AND PLANNING
It’s important for participants and buyers to carefully read all information provided on our website and in any documents we send. If you notice any errors or have questions, please contact us promptly. We cannot be held responsible if inaccuracies are not brought to our attention within seven days of receiving the documents. Before the trip, you must submit a waiver of liability and assumption of risk agreement, and a medical statement if required. Failure to provide these documents before departure may result in cancellation of your booking, and you may be subject to cancellation fees as described in this agreement.
We recommend that clients consult with our office before booking flights. Any travel plans, including flights and any additional requests such as extra room nights or bike rentals, should be submitted to our office at least 100 days prior to the trip. If you are unable to make all requests by 90 days before the trip, please inform us of your plans and we will do our best to accommodate last-minute requests.
BOOKING FLIGHTS
To ensure a smooth and hassle-free travel experience, participants are responsible for booking and paying for their own flights to the starting and/or finishing location for Mountain Bike Colombia S.A.S trips. Before purchasing flights, riders should ensure that they are familiar with airline policies and costs for excess or oversize baggage. Layovers shorter than one and a half hours should be avoided. To confirm the best time of arrival and departure, riders should contact us before booking their flight, as some trips offer only one arrival transfer per trip. Additionally, riders should confirm with us that the trip has enough participants to confirm the trip or enough space for them to join before booking their flights.
SINGLE ROOM SUPPLEMENTS
The single room supplement is an extra charge for participants who want their own room throughout the trip. The amount of this fee varies depending on the specific trip. If you are traveling alone but do not want to pay for a single supplement, Mountain Bike Colombia S.A.S will pair you with someone of the same gender. However, if there is no other single person of the same gender to pair you with, you will be required to pay the single supplement fee.
ACCEPTANCE AND PAYMENTS
After registering for your chosen trip via our registration system or other agreed-upon methods, you will receive a confirmation email and receipt of your deposit payment. Please note that a trip booking is not confirmed until we receive a payment (either a deposit or full balance) and your completed registration. Once we have issued a booking confirmation by email confirming the details of your booking, a binding contract will come into existence between you and us.
Before the payment deadline, we will send you a payment reminder. The payment deadline may vary depending on whether your departure is scheduled or private. If you prefer, you can choose to pay the full balance at any time by emailing our office.
All invoices are quoted in U.S dollars and converted at the time of payment from the quoted currency used on each trip page, as used and preferred by each destination.
AGE
Our general policy requires riders to be at least 18 years old for most of our adventures. However, in special cases such as private and club adventures, we may allow riders between 15 and 18 years old if they are accompanied by a parent or legal guardian during the ride. The final decision for a minor to join a trip will be made by the Mountain Bike Colombia Adventure Crew Leader. It is the responsibility of the rider and parent to make the decision to join, and they are expected to have read all information regarding the required fitness and skills for the ride adventure.
DISASTERS, POLITICAL INSTABILITY OR LIMITING EVENTS
We want to make sure you are aware that natural disasters, such as volcanic eruptions, landslides, flooding, wildfires, earthquakes, droughts, major storms, and other events like political instability, can occur at any destination where we operate our trips. We will do our best to inform you in advance of any disruptions to your trip, but sometimes these situations can arise unexpectedly and can affect the itinerary.
If we need to postpone, cancel, or modify the trip itinerary for your safety due to a natural disaster or political instability, Mountain Bike Colombia cannot be held responsible for any loss of funds. It is important for all riders to have comprehensive travel insurance that covers these types of situations.
CORRECTIONS, FLEXIBILITY AND ITINERARY MODIFICATIONS
We understand that traveling with us requires flexibility, and we may need to make changes to our itinerary due to local circumstances or events. While our website itinerary provides a general overview of the activities planned, we will provide a detailed itinerary specific to your trip that addresses any questions or changes.
Please note that Mountain Bike Colombia S.A.S. reserves the right to correct errors in trip prices and adjust prices due to fluctuations in transportation costs, accommodation rates, fuel, taxes, fees, and exchange rates. We will notify riders of any changes to prices at least 60 days before the trip. If the price increase exceeds 10% of the amount quoted at the time of registration, you may choose to transfer your payment as a credit to another trip. If the trip price decreases, we will issue refunds for the difference. If a rider wishes to cancel due to a price change, they must confirm within seven days of being notified of the change. Upon request, we will process refunds for any differences, less a 5% administration fee.
PASSPORT, TRAVEL VISAS AND TRAVEL VACCINATIONS
As a participant, it is your responsibility to ensure that you have all necessary travel documents with you for the entire tour, and that they are valid. This includes ensuring that your passport is valid for at least six months beyond the date of return. You are solely responsible for verifying and complying with any and all passport, visa, vaccination, or other entry requirements, and for any consequences that may result from incomplete or defective documentation. Although we may offer information or advice on matters such as visas, vaccinations, climate, clothing, baggage, and special equipment, this is done as a courtesy, and we are not responsible for any errors or omissions. We cannot be held liable if you are unable to travel or incur any other losses due to failure to comply with any passport, visa, immigration requirements, or health formalities. If you fail to comply with any requirements or health formalities and Mountain Bike Colombia S.A.S incurs any fines or losses as a result, you agree to reimburse us for these costs.
HEALTH AND FITNESS REQUIREMENTS
Before registering for a trip, participants must carefully read and understand the Ability Level required for the trip (as explained at https://mountainbikecolombia.com/mountain-bike-skills-and-fit-levels-explanation/). Participants should be healthy, active, and follow our recommended fitness training before departure. If you have any medical conditions, it is important that you inform us well in advance of the trip. When you register for a trip with Mountain Bike Colombia S.A.S, you will be asked to complete a set of questions about your fitness, experience, and health or medical conditions. Please answer these questions completely and honestly, as we need to ensure that you are physically able to participate in the trip. If you have any medical conditions that may affect your fitness, you should consult your physician before registering for the trip. Please note that we are not responsible for providing medical care, and we reserve the right to decline bookings or modify the itinerary on medical grounds at any time. Keep in mind that finding hospital facilities for serious problems and evacuation may be difficult, prolonged, difficult, and expensive.
THEFT, LOSS AND DAMAGES
During our bike adventures, Mountain Bike Colombia S.A.S and its staff and partners are not responsible for any loss, theft, or damage to your bike, bags, or personal items. You are responsible for taking good care of your belongings and preventing theft. You must approve the loading and unloading of your bike from vehicles, as well as its storage and transport. If you have any concerns or doubts, please talk to your guide or host and agree on an alternative arrangement for bike transport or storage. For added security, we recommend that you bring a durable lock and use it even in your hotel room. Please ensure that your belongings are properly insured for their full value. We also recommend that you protect your bike frames with 3M protective film to minimize the risk of scratches.
YOUR BIKE OR THIRD-PARTY RENTAL BIKES
Participants must bring their own suitable bike for the trip and are responsible for ensuring that it is in good condition and properly maintained throughout the trip. Daily bike checks must be performed by riders, and guides should be notified of any mechanical issues or assistance required. Riders must have the appropriate parts and tools to ensure that their bikes are functioning properly. If a rental bike is provided through a third-party company, riders are responsible for its condition, maintenance, damages, and theft during the trip. Additionally, riders must build and unpack their bikes upon arrival and pack them at the end of the trip. While our guides are available to assist with unpacking, packing, and mechanical issues, the participant ultimately bears the responsibility for their bike’s care. It is your responsibility to have sufficient insurance coverage for the bike that you will be using on the tour.
SPECIAL REQUESTS
We kindly request that you communicate any special requests in writing at the time of booking. This may include requests related to your diet, allergies, injuries, or room arrangements. While we will make every effort to fulfill your reasonable requests, we cannot guarantee that we will be able to do so. Please note that simply noting a special request on your confirmation invoice or other documentation, or passing it on to our suppliers, does not confirm that the request will be met. Unless we have specifically confirmed a special request, failure to meet it will not be considered a breach of our contract.
Please note that we cannot accept bookings that are conditional upon a special request being met. We appreciate your understanding in this matter.
YOUR ACCOUNT AND ACCURACY
By using our site, you agree to keep your account and password (if applicable) confidential and to prevent unauthorized access to your computer. You are responsible for all activities that occur under your account and password.
You must not transmit any harmful code, such as worms or viruses. Violating any of our terms will result in an immediate termination of your services.
We reserve the right to refuse any orders or bookings and may limit or cancel purchases per person, per household, or per order at our sole discretion. These restrictions may include orders or bookings placed under the same customer account, credit card, or billing and shipping address. If we make changes or cancel an order, we may attempt to notify you using the email and/or billing address/phone number provided at the time of purchase. We reserve the right to limit or prohibit orders placed by dealers, resellers, or distributors, as determined by us.
You must provide accurate purchase and account information for all transactions, and update your account information, including email address and credit card details, promptly to ensure smooth processing and communication.

USER COMMENTS, FEEDBACK AND OTHER SUBMISSIONS
We reserve the right to monitor, edit or remove content that we believe, in our sole discretion, to be illegal, offensive, threatening, libelous, defamatory, pornographic, obscene, or objectionable, or that violates any party’s intellectual property or our Terms of Service.
By submitting comments, you agree that your comments will not violate any third-party rights, including copyright, trademark, privacy, personality, or any other personal or proprietary right. Additionally, your comments must not contain unlawful, abusive, or obscene material, or any computer viruses or malware that may affect the Service’s operation or any related website. You may not use a false email address, impersonate someone else, or mislead us or third parties about the origin of your comments. You are solely responsible for the accuracy of your comments. We are not responsible for any comments posted by you or any third party, and we assume no liability for them.
ERRORS, INACCURACIES AND OMISSIONS
Occasionally there may be information on our site that contains errors, inaccuracies or omissions that may relate to descriptions, pricing, promotions, offers, shipping charges, transit times or availability. We reserve the right to correct any inaccuracies and to change or update information or cancel if any information in the Service or on any related website is inaccurate at any time without prior notice (including after you have submitted your order).
INDEMNIFICATION
By using our services, you are agreeing to protect and hold harmless Mountain Bike Colombia, our parent company, subsidiaries, Surf Republica, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees from any claims or demands, including reasonable legal fees, made by a third-party due to or arising from your breach of our Terms of Service or any documents that are referenced within them, or your violation of any law or the rights of a third-party.
GOVERNING LAW
These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of Colombia.

MBC MARKETING AFFILIATE AND OUR GROUP ORGANIZER PROGRAM, TERMS AND CONDITIONS
We’ve made these Terms and Conditions to make sure that we have a clear and transparent partnership with our affiliates. Please read the entire agreement carefully. By joining the Mountain Bike Colombia, Marketing Affiliate Program (MAP) or our Group Organizer Program, (GO) you agree that you have read and understood this agreement. You also confirm that you have the full right, power, and authority to enter into and be bound by these Terms and Conditions without needing the approval or consent of any other party.
MARKETING AFFILIATE and our GROUP ORGANIZER PROGRAM TERMS AND CONDITIONS
Mountain Bike Colombia MBC is an adventure company based in Colombia that owns and operates the affiliate program. When referring to the affiliate program or the legal entity that owns it, the term “Mountain Bike Colombia MBC” will be used.
1. REGISTRATION
To become a Mountain Bike Colombia MBC Marketing Affiliate, or a Adventure Group Organizer, we will review your application manually to ensure that we are a good fit. This process typically takes up to 5 business days, and we will notify you of our decision via email.
As an affiliate, you agree to receive occasional emails from us regarding changes to the affiliate program terms and conditions, news and updates, and other relevant information.
You must provide accurate information about yourself, your business, and the website(s) or platforms where you intend to promote Mountain Bike Colombia MBC adventures.
We may reject applications for a variety of reasons, including websites or businesses that promote or display violence, discrimination, sexually explicit materials, copyright or trademark infringement, spamming, scamming, or any other illegal activities. Additionally, if your domain name includes variations or misspellings of “Mountain Bike Colombia, MBC,” or if your website design replicates or resembles ours in a way that leads customers to believe you are Mountain Bike Colombia MBC or an affiliated business, we may reject your application. We also reserve the right to decline applications at our sole discretion if we determine that the applicant’s standards are not aligned with ours or are inappropriate for the adventures we sell. Please note that this list is not exhaustive, and we may decline your application without providing a rejection reason.
2. COMMISSIONS AND PAYOUTS
You will receive a standard commission rate of $20 USD for each guest that books one of our MBC adventures from your network or adventure page, using the referral link that we provide you through our affiliate account and emails. The commission only applies to the cost of the adventure and excludes taxes, transportation, insurance, and other service costs.
We will pay commissions only for fully booked adventures that have entered into the 60-day non-refundable window. This means that all available seats in the group adventure have been paid in full, all guests have received a completed booking confirmation notice from Mountain Bike Colombia MBC, and the adventure has entered into the 60-day non-refund window. No adventure cancellations by clients at this point are eligible for a cash refund. The minimum commission payout is $160 USD.
Payments can be made in person upon your arrival in Colombia and will be paid in COP, which is the default payment method preferred by most affiliate group organizers. Alternatively, payments can be deposited into your bank account in USD. For example, if your group adventure of 10 seats becomes fully booked by March 31st (30 days before departure) and is well into the 60-day non-refund window, and you have $200 USD in accepted and unpaid commissions in your balance, you can request the commission to be paid into your bank account or via PayPal. You will need to send us an invoice for the $200 USD, and we will transfer the amount to your bank or PayPal account one day after the group arrival into Colombia.
You are responsible for complying with any laws and taxes you might be subject to in your country of residence as a result of rendering affiliate services to us.
We reserve the right to lower or increase our standard commission rates at any time and for any reason. You will be notified via email 30 days in advance before such changes go into effect.
All commissions are subject to approval before they can be paid. You can check the status of each commission in your affiliate program dashboard, which will show as “Pending”, “Unpaid”, “Rejected”, or “Paid”.
Using your own affiliate link to purchase Mountain Bike Colombia adventures is not allowed.
3. PROMOTION PERMISSIONS & RESTRICTIONS
You may use the following methods to promote Mountain Bike Colombia and earn commissions through our affiliate program:
- Sharing your affiliate link directly with friends or potential customers who might be interested in an adventure with us.
- Writing reviews or articles on your blog, social media channels, or website about Mountain Bike Colombia and linking to our group adventures with the provided creative assets.
- Using your social media accounts to share your MBC affiliate link and group adventure booking page with your audience.
- Promoting your MBC Group adventure page in emails, provided the recipient is already a customer or subscriber of your services or website and has the option to remove themselves from future mailings.
- Mentioning your affiliate link or group adventure page on your podcast, along with a discount code.
We do not tolerate certain promotional methods and will terminate your account if you engage in such activities:
- Spamming in any form or on any platform, including unsolicited promotional emails, mass commenting on websites, posting your affiliate link on groups and forums where it’s not allowed, or sending unsolicited direct messages.
- Misrepresenting our brand or products in any way, such as by using false information about our adventures, using fake testimonials, or pretending to be an employee of Mountain Bike Colombia MBC.
- Placing your affiliate link or group adventure page on any coupon websites.
This is not an exhaustive list, and we may terminate your account if we consider your promotional activities are not aligned with our business values. If you are unsure whether a particular promotional method is allowed, please contact us in advance for confirmation.
4. ACCOUNT TERMINATION
You or we may terminate this Agreement at any time, with or without reason, by giving written notice via email to the other party.
Furthermore, we may terminate your account at any time without prior notice, if we determine that you have violated any of the Terms and Conditions of this Agreement. If you have any outstanding or unpaid commissions that are related to your violation of our Terms and Conditions, they will be withheld.
5. Affiliate Group Organizer
By registering and being approved as an affiliate to the Mountain Bike Colombia MBC Affiliate Program, you agree to follow the rules and guidelines outlined in our Terms and Conditions.
As an affiliate, you acknowledge that you are an independent contractor and that the affiliate relationship does not establish an employment relationship with Mountain Bike Colombia MBC. You do not have the authority to make or accept any offers or representations on our behalf.
It is important to understand that this affiliate relationship is not legally binding, which means that you may not take legal action against Mountain Bike Colombia MBC.
Please note that our Terms and Conditions are subject to change, and we will notify you in advance of any such changes. You have the right to opt-out of our affiliate program at any time by emailing us.
