Mountain Bike Colombia MTB Adventure Assumption of All Risks, Release of Liability, and Hold Harmless Agreement #

ย
Updated September 13, 2025

At Mountain Bike Colombia, we are honored to share the thrill and challenge of wilderness mountain biking with our guests. Please read this policy carefully before booking. By reserving an adventure, you fully accept and agree to these terms.

Assumption of All Risks, Release of Liability, and Hold Harmless Agreement #

Acknowledgment and Acceptance of Risks #

By signing up and joining any Mountain Bike Colombia adventure, I acknowledge that I am voluntarily participating in a potentially dangerous mountain biking activity in remote and rugged regions of Colombia. I understand that mountain biking, travel in developing regions, and associated activitiesโ€”including transport by off-road bikes, buses, boats, canopy cables, and planesโ€”carry inherent risks that may result in personal injury, illness, property damage, or even death.

I further understand that qualified medical care may be hours or even days away, and in remote regions such as the Amazon, evacuation may be delayed or unavailable. While Mountain Bike Colombia guides are trained in basic first aid, they are not medical professionals, and timely emergency treatment cannot be guaranteed.

Risks Specific to Colombia #

I acknowledge the unique risks associated with travel in Colombia, including but not limited to:

  • Unpredictable terrain with steep descents, loose rock, mud, landslides, and sudden obstacles.

  • Wildlife encounters, including snakes, insects, jaguars, monkeys, and other unpredictable animals.

  • Environmental conditions, including heat, humidity, flooding rivers, storms, and rapid weather changes.

  • Security risks, including political unrest, strikes, theft, or regional conflicts.

  • Transportation risks from buses, boats, small planes, or jeeps in remote areas.

  • Cultural risks when visiting Indigenous communities, where photography, personal conduct, and entry into homes are regulated by cultural and legal protections.

I acknowledge that some Indigenous communities in Colombia enjoy special legal protections under Colombian and international law. I agree to follow all protocols as directed by Mountain Bike Colombia, including:

  • No unauthorized photography.

  • No collecting or providing personal contact information from persons in the communities.

  • No entering private spaces without explicit permission.

  • Full respect for cultural traditions, ceremonies, and leaders.

I understand that violations of these rules may result in immediate removal from the adventure, potential legal consequences, or actions taken by the communities themselves.

Equipment & Rider Responsibility #

  • I confirm that I am an experienced cyclist or have disclosed my skill level honestly.

  • I accept responsibility for bringing and maintaining a properly functioning bike (if bringing my own).

  • I understand that e-bikes are restricted on certain adventures (including Amazon and MaxAir) due to safety and logistical concerns.

  • I will carry sunscreen, insect repellent, rain gear, hydration, and any medications required for my personal health.

  • I have disclosed all medical conditions to the ride leadership and provided emergency contact information.

Release of Liability #

By booking, placing a deposit, or signing this agreement, I release, discharge, and hold harmless Mountain Bike Colombia, its owners, employees, guides, affiliates, contractors, and associated personnel from any and all liability, claims, demands, or causes of action arising from my participation, whether caused by negligence, acts of God, or other factors beyond their control.

This release covers but is not limited to:

  • Injuries, illnesses, or death.

  • Loss or damage of property.

  • Delays, cancellations, or changes in itinerary due to weather, politics, natural disasters, or logistical issues.

Participantโ€™s Commitments #

  • I will follow the instructions of Mountain Bike Colombia guides at all times.

  • I accept that weather, trail, and cultural conditions may change plans unexpectedly.

  • I agree to maintain respectful conduct toward local communities, guides, and fellow participants.

  • I accept responsibility for my own actions and any consequences resulting from them.

Special Provisions for Minors #

If the participant is under 18, I, the parent or legal guardian, acknowledge that I have read and accepted all terms on their behalf. I confirm that the minor understands the risks to the extent reasonably possible and consents to participate.

Final Acknowledgment #

By placing my deposit, signing up for a trip, participating on a Mountain Bike Colombia or signing this agreement, I confirm that I have read, understood, and accepted in it’s entirety this Assumption of Risk and Release of all Liability agreement with Mountain Bike Colombia. I acknowledge that it is a legally binding document and that I am waiving certain legal rights by taking part in this extreme sport activity with Mountain Bike Colombia.

  • Once confirmed, you will receive an email with your itinerary, packing list, and payment instructions.

3. Payment Terms #

  • A per-person reservation deposit (listed on each adventure page) secures your booking.

  • Remaining balance is due upon check-in in Colombia.

  • Payments:

    • Credit card (+5% service fee).

    • Cash in COP (Colombian pesos) with a 5% discount to offset exchange costs.

4. Cancellation Policy #

By Participant:

  • Deposits are fully refundable if cancellation is made 61 days or more before the adventure start date.

  • If cancellation is made 60 days or less before the start date, the deposit becomes non-refundable.

  • If cancellation occurs 61+ days prior, you may also choose to:

    • Transfer your deposit to another adventure, OR

    • Keep it on account for a future trip within the same calendar year.

By Mountain Bike Colombia:

  • If we must cancel due to circumstances beyond our control (war, natural disasters, political unrest, etc.):

    • Participants will receive a full refund of deposits paid, plus a free deposit credit toward a future adventure.

Travel Insurance:

  • Strongly recommended. Should cover trip cancellation, interruptions, medical expenses, evacuation, and unforeseen events.

How to Cancel:

5. Trip Modifications #

Mountain Bike Colombia may adjust itineraries, routes, or accommodations when necessary due to factors beyond our control (e.g., weather, wildlife activity, water levels, or community availability).

These modifications ensure safety, quality, and respect for local conditions. Flexibility is a key part of every wilderness adventure.

6. Participant Requirements #

  • Meet the minimum age and skill level required for the chosen adventure.

  • Maintain reasonable fitness and stamina; Amazon adventures may involve discomfort in remote conditions.

  • Previous mountain biking experience is recommended but not always mandatory.

  • All participants must sign the Release of Liability Waiver before the trip begins.

  • Minors: Parents/guardians must ensure the minor meets all physical and skill requirements, and must accompany them on the trip unless otherwise arranged in writing.

7. Safety & Responsibility #

  • Safety is our top priority, but it requires shared responsibility.

  • Participants must follow guide instructions and established safety practices at all times.

  • By booking, participants confirm they:

    • Accept the inherent risks of mountain biking.

    • Understand that medical care may be delayed in remote areas.

    • Are physically capable of participating.

    • Will carry personal travel/medical insurance coverage.

  • For minors: Parents/guardians accept full legal and financial responsibility for their childโ€™s safety, conduct, and compliance with these terms.

  • E-Bike Booking Policy (E-Bike Disclaimer) #

    • E-Bike Policy:

      • E-bikes are welcome on many Mountain Bike Colombia adventures.

      • Exceptions: E-bikes are not permitted on the Amazon MTB Adventures (5โ€“9 days) or the MaxAir Adventure.

      • Reasoning:

        • Amazon Adventures โ†’ lack of charging facilities, remoteness, and transport complications with batteries in boats, small planes, and jungle terrain.

        • MaxAir Adventure โ†’ cable systems are weight-sensitive; the additional mass of e-bikes creates unacceptable safety risks for the group and equipment.

      • Riders bringing e-bikes on other adventures must notify us in advance so we can confirm suitability and logistics.

8. Code of Conduct #

Respectful behavior is a core condition of joining a Mountain Bike Colombia adventure. Participants must:

Indigenous Community Protocols #

  • Follow all cultural, social, and safety protocols established by our guides and the Indigenous communities we visit.

  • Photography: No photos or videos may be taken without clear permission from both the guide and the community. Unauthorized photography is a serious violation.

  • Personal Information: Collecting private contact details (phone numbers, social media, etc.) from community members is strictly prohibited.

  • Homes & Spaces: Entering community homes or private spaces without an explicit invitation is forbidden.

Many of the Indigenous communities we work with hold special legal protections under Colombian law and international frameworks (including the United Nations Declaration on the Rights of Indigenous Peoples). Violations of their protocols may therefore:

  • Constitute a legal offense.

  • Result in legal action against the participant.

  • Lead to immediate removal from the adventure at the participantโ€™s own expense.

  • Cause permanent exclusion from future Mountain Bike Colombia adventures.

General Conduct #

  • Show respect for local communities, wildlife, and ecosystems.

  • Engage in sustainable travel practices and minimize environmental impact.

  • Approach every adventure with gratitude, patience, and flexibilityโ€”qualities essential in remote and unpredictable wilderness environments.

9. Policy Updates #

This policy may be updated at any time without prior notice. Participants are responsible for reviewing it before booking.

Agreement #

By booking a Mountain Bike Colombia adventure, you acknowledge that you:

  1. Have read, understood, and accepted this policy.

  2. Fully accept the inherent dangers of mountain biking.

  3. Accept the risks associated with delayed or limited medical care in remote areas.

  4. Accept the responsibility of respecting Indigenous protocols, including rules on photography, personal contact, and private spaces.

  5. Understand that violations may result in legal consequences under Colombian and international law.

  6. Agree to abide by the terms, conditions, and responsibilities outlined herein.

  7. For minors: Parents or legal guardians confirm they have read and accepted these terms on behalf of their child, and accept full responsibility for the childโ€™s participation and conduct.
